{"id":1060,"date":"2020-03-22T13:16:00","date_gmt":"2020-03-22T13:16:00","guid":{"rendered":"https:\/\/www.cookiebot.com\/en\/?p=1060"},"modified":"2026-03-12T08:19:27","modified_gmt":"2026-03-12T08:19:27","slug":"cookie-walls","status":"publish","type":"post","link":"https:\/\/www.cookiebot.com\/us\/cookie-walls\/","title":{"rendered":"EDPB and Cookie Walls"},"content":{"rendered":"\n<ol class=\"wp-block-list\">\n<li><strong>what is a cookie wall?<\/strong><\/li>\n\n\n\n<li><strong>EDPB guidelines: are cookie walls legal?<\/strong><\/li>\n\n\n\n<li><strong>how do cookie walls work?<\/strong><\/li>\n\n\n\n<li><strong>and what is an alternative, valid way of obtaining user consent?<\/strong><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-cookie-wall\">What is a cookie wall?<\/h2>\n\n\n\n<p>A cookie wall is very much what it sounds like: it\u2019s a wall around a website that users can only get through by accepting cookies and trackers on the domain, most of which will be processing their personal data.<\/p>\n\n\n\n<p>A cookie wall is a \u201ctake it or leave it\u201d-scenario that a website sets up for users so that it can ensure to activate all cookies and trackers and get as much data as possible, even if it is against the user\u2019s wishes.<\/p>\n\n\n\n<p>Some websites may use a cookie wall in fear that granular consent will break their websites, if users are left with the choice to consent to only some cookies rather than others. Later in this blogpost, we will debunk this myth.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-does-a-cookie-wall-look-like\">What does a cookie wall look like?<\/h3>\n\n\n\n<p>In practice, a cookie wall is a particular variation of the cookie banner that users are used to interact with on the Internet today. Only, a cookie wall leaves no real option for the user to select or deselect certain categories of cookies, like marketing cookies that typically harbor myriads of private data trackers from ad tech companies. This means that the cookie banner, which is supposed to be an interactive solution enabling granular consent for the user, becomes instead a cookie wall \u2013 and the only way through is to click OK.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter is-resized is-style-default\"><img decoding=\"async\" src=\"\/media\/4210\/skaermbillede-2019-10-24-kl-125206.png?width=500&amp;\" alt=\"A cookie wall made with non-correct implementation of Cookiebot CMP. - Cookiebot\" width=\"713px\" height=\"134px\"\/><figcaption class=\"wp-element-caption\">A cookie banner implemented in a way that forces a bundled consent from users, also known as a \u201ccookie wall\u201d. Cookie banners can be implemented in different ways to suit different privacy laws around the world, but in the EU, the above implementation is non-compliant.<\/figcaption><\/figure>\n\n\n\n<p>Cookie walls exist on myriad of sites throughout the web, even on many news sites that people rely on for their daily information (and reporting on privacy issues, ironically).<\/p>\n\n\n\n<p>Imagine that you\u2019re trying to buy a newspaper, but you can only read it if you disclose everything in detail about your closest relationships and family to the stranger selling it, and dozens of other third parties.<\/p>\n\n\n\n<p>Or imagine that you\u2019re trying to enter a supermarket, but the only way you can go shop is by taking off your clothes, handing over your wallet and social security number before entering.<\/p>\n\n\n\n<p>It sounds absurd, but it\u2019s comparable to the situation that a cookie wall puts an end-user in, when it demands as payment for access that they relinquish control of their own private data and hand it over to ad tech companies who create eerily detailed profiles on individuals and sell these in real time bidding schemes <a href=\"https:\/\/www.theguardian.com\/technology\/2019\/jan\/20\/shoshana-zuboff-age-of-surveillance-capitalism-google-facebook\/\" target=\"_blank\" rel=\"noreferrer noopener\">on the behavioral futures markets<\/a>.<\/p>\n\n\n\n<p><a href=\"\/en\/gdpr-cookies\/\">Learn more about GDPR and consent<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-edpb-guidelines-on-valid-consent-are-cookie-walls-legal\">EDPB guidelines on valid consent: are cookie walls legal?<\/h2>\n\n\n\n<p>No! Cookie walls are an illegal way of obtaining user consent of individuals inside the EU.<\/p>\n\n\n\n<p>On May 4, 2020, the <a href=\"https:\/\/edpb.europa.eu\/edpb_en\/\" target=\"_blank\" rel=\"noreferrer noopener\">European Data Protection Board (EDPB)<\/a>&nbsp;released <a href=\"\/en\/edpb-guidelines\/\">new guidelines<\/a>&nbsp;that clarify the legality of cookie walls and what constitutes a valid consent.<\/p>\n\n\n\n<p>The EDPB is an independent supervisory body made up of representatives from all national data protection authorities in the EU.<\/p>\n\n\n\n<p>It\u2019s the job of the EDPB to ensure a consistent application of the GDPR and ePrivacy directive inside the EU by adopting guidelines and directing national data protection authorities towards coherent enforcement.<\/p>\n\n\n\n<p>The <a href=\"\/en\/edpb-guidelines\/\">EDPB guidelines 05\/2020<\/a>&nbsp;effectively rule out cookie walls as a valid means for websites to obtain consent from their users to process their personal data.<\/p>\n\n\n\n<p>The EDPB states clearly in their guidelines that cookie walls are illegal.<\/p>\n\n\n\n<p>Cookie walls work by making access to a service conditional on the consent of users for processing their personal data, and the EDPB state in their guidelines that this does not constitute valid consent.<\/p>\n\n\n\n<p><em>\u201cAccess to services and functionalities must not be made conditional on the consent of a user to the storing, or gaining of access to information already stored, in the terminal equipment of a user\u201d<\/em>&nbsp;(EDPB guidelines 05\/2020, page 11)<\/p>\n\n\n\n<p>This <a href=\"\/en\/edpb-guidelines\/\">EDPB guidelines<\/a>&nbsp;rules out cookie walls, since \u2013 as we have explained \u2013 cookie walls operate by forcing consent from users to store cookies or accessing already stored cookies in exchange for access to services and functionalities.<\/p>\n\n\n\n<p>And so, <strong>cookie walls are not compliant with the GDPR<\/strong>, since they do not meet the requirements for a consent to be freely given and on the basis of a genuine choice.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gdpr-on-consent\">GDPR on consent<\/h3>\n\n\n\n<p>Valid consent according to the GDPR is formed by four aspects:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Freely given<\/li>\n\n\n\n<li>Specific<\/li>\n\n\n\n<li>Informed<\/li>\n\n\n\n<li>Unambiguous indication of the user\u2019s wishes<\/li>\n<\/ul>\n\n\n\n<p>In other words, a valid consent must be a freely given, specific, informed and unambiguous indication that the user accepts your website\u2019s use of cookies and trackers to process their personal data. A valid consent must be a clear and affirmative action on the part of the user.<\/p>\n\n\n\n<p>The GDPR spells out clearly that consent must be freely given, and the EDPB\u2019s guidelines from May 2020 clarify that user consent obtained through cookie walls are invalid, exactly because the consent wasn\u2019t given&nbsp;<em>freely<\/em>&nbsp;in the first place, since it was conditional to visit the website.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter is-resized is-style-cb-rounded\"><img decoding=\"async\" src=\"\/media\/3738\/patrick-tomasso-qmdap1tau0g-unsplash.jpg?width=379&amp;\" alt=\"White brick wall with a blue square painted on it - Cookiebot\" width=\"770px\" height=\"578px\"\/><figcaption class=\"wp-element-caption\">The EDPB guidelines from May 2020 makes cookie walls illegal.<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-a-cookie-wall-work\">How does a cookie wall work?<\/h2>\n\n\n\n<p>Most websites in the world have first and third-party cookies embedded in their source code. They range from necessary cookies that are fundamental to the operation of a website to statistics cookies that often use anonymized data to give insight into how a website performs.<\/p>\n\n\n\n<p>Then, there are marketing cookies that are placed by ad tech companies entirely for the purpose of collecting personal data in order to target users in behavioral advertising schemes (and for other ominous ends).<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter is-resized is-style-cb-rounded\"><img decoding=\"async\" src=\"\/media\/3737\/wesley-tingey-mvlyhprglcs-unsplash.jpg?width=372&amp;\" alt=\"Purple brick wall - Cookiebot\" width=\"770px\" height=\"498px\"\/><figcaption class=\"wp-element-caption\">Cookie walls work by making consent a condition of access to a website and its services, denying users entry unless they give full consent to all cookies.<\/figcaption><\/figure>\n\n\n\n<p>The many different types of cookies have many different purposes \u2013 some are straight-up privacy infringing, which is why the European data protection legislations \u2013 the <a href=\"\/en\/gdpr\/\">General Data Protection Regulation<\/a>&nbsp;and the <a href=\"\/en\/cookie-law\/\">ePrivacy Directive<\/a>&nbsp;\u2013 are in place to control and regulate how these cookies and trackers are allowed to be used by companies, organizations and websites.<\/p>\n\n\n\n<p>The GDPR mandates that data controllers obtain the prior consent of users before any processing of their data is allowed to take place. Consent is one of six legal bases for processing personal data in the EU and the most widely used for websites and companies across the world.<\/p>\n\n\n\n<p>And so, the cookie consent banner was born as a way for data controllers to be GDPR and ePR compliant by acquiring user consents for data processing.<\/p>\n\n\n\n<p>A cookie wall is a hybrid cookie banner that obtains something like a user consent but leaves out any choice for the user to granulate their consent to certain types of cookies rather than others. It works by blocking access unless a user clicks \u2018o.k.\u2019 to all cookies and trackers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cookiebot-cmp-on-cookie-walls\">Cookiebot CMP on cookie walls<\/h2>\n\n\n\n<p><a href=\"\/\">Cookiebot CMP<\/a>&nbsp;offers granular consent as opposed to cookie walls. Websites are not allowed to deny access to users who decide not to consent to cookies and trackers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-british-dpa-on-cookie-walls\">The British DPA on cookie walls<\/h3>\n\n\n\n<p>The British data protection authority <a href=\"https:\/\/ico.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\">ICO<\/a>&nbsp;also updated their guidelines for the use of cookies in GDPR compliance in the summer of 2019.<\/p>\n\n\n\n<p>Applying the standard for consent of the GDPR to the national implementations of the ePrivacy Directive (in Britain the <a href=\"https:\/\/ico.org.uk\/for-organisations\/guide-to-pecr\/what-are-pecr\/\" target=\"_blank\" rel=\"noreferrer noopener\">PECR<\/a>), the British ICO decided that no cookie categories except necessary are allowed to have pre-ticked checkboxes.<\/p>\n\n\n\n<p>The ICO also specified that using a cookie wall to restrict access to a site until users consent is not GDPR (and PECR) compliant.<\/p>\n\n\n\n<p><em>\u201cUsing a blanket approach such as this is unlikely to represent valid consent. Statements such as \u2018by continuing to use this website you are agreeing to cookies\u2019 is not valid consent under the higher GDPR standard\u201d.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-french-dpa-on-cookie-walls\">The French DPA on cookie walls<\/h3>\n\n\n\n<p>The French data protection authority <a href=\"https:\/\/www.cnil.fr\/en\/home\/\" target=\"_blank\" rel=\"noreferrer noopener\">CNIL<\/a>&nbsp;also updated their guidelines in the summer of 2019 and issued the same opposition to cookie walls as the British and Dutch DPAs.<\/p>\n\n\n\n<p>However, France's highest administrative authority (the Conseil d'\u00c9tat) ruled that CNIL had exceeded its authority when it decided that blocking access to a website for users who don\u2019t give their full cookie consent was non-compliant by default.<\/p>\n\n\n\n<p>In its decision, the Conseil d\u2019\u00c9tat stated that CNIL cannot legally prohibit cookie walls. It did, however, confirm all other points of CNIL\u2019s guidelines, which had been contested.<\/p>\n\n\n\n<p>In the <a href=\"https:\/\/www.cnil.fr\/fr\/cookies-et-autres-traceurs-la-cnil-publie-des-lignes-directrices-modificatives-et-sa-recommandation\/\" target=\"_blank\" rel=\"noreferrer noopener\">new guidelines from September 17, 2020<\/a>, CNIL has rephrased its guidance on cookie walls and states instead that cookie walls are&nbsp;<em>\u201dlikely to infringe, in certain cases, the freedom of consent\u201d<\/em>.<\/p>\n\n\n\n<p>On March 18, 2021, CNIL also published <a href=\"https:\/\/www.cnil.fr\/fr\/questions-reponses-lignes-directrices-modificatives-et-recommandation-cookies-traceurs\/\" target=\"_blank\" rel=\"noreferrer noopener\">an FAQ on its cookie guidelines (in French)<\/a>, including details on its guidance on the use of cookie walls.<\/p>\n\n\n\n<p>On the topic, CNIL\u2019s FAQ specifies that the implementation of cookie walls&nbsp;<em>\"must be assessed on a case-by-case basis\"<\/em>.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.cnil.fr\/fr\/cookies-et-autres-traceurs-la-cnil-publie-des-lignes-directrices-modificatives-et-sa-recommandation\/\" target=\"_blank\" rel=\"noreferrer noopener\">See CNIL's new guidelines from September 17, 2020 (in French)<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-spanish-dpa-on-cookie-walls\">The Spanish DPA on cookie walls<\/h3>\n\n\n\n<p>In the summer of 2020, the Spanish data protection authority <a href=\"https:\/\/www.aepd.es\/\" target=\"_blank\" rel=\"noreferrer noopener\">AEPD<\/a>&nbsp;updated their guidelines on cookie walls.<\/p>\n\n\n\n<p>In similar fashion to the British ICO and the Dutch AP, the Spanish AEPD ruled that <strong>cookie walls that do not offer an alternative to consent are not allowed<\/strong>.<\/p>\n\n\n\n<p>In other words, <strong>cookie walls are deemed non-compliant<\/strong>&nbsp;by the Spanish AEPD unless an equivalent alternative to access without the user having to give their consent is provided.<\/p>\n\n\n\n<p>AEPD highlights that cookie walls are particularly problematic in cases where <strong>users are denied access to a website when trying to exercise a legal right<\/strong>, e.g. to unsubscribe from a service.<\/p>\n\n\n\n<p>Websites in Spain that do not offer a proper and equal alternative to access without consent is in non-compliance with the AEPD\u2019s guidelines on cookie walls.<\/p>\n\n\n\n<p>The AEPD guidelines also specify that <strong>continued scrolling on websites does not constitute valid consent<\/strong>, i.e. consent must be an explicit and unambiguous indication of the user\u2019s choice.<\/p>\n\n\n\n<p>The AEPD guidelines were released in July 2020 with a three months grace period and <strong>took&nbsp;effect on October 31, 2020<\/strong>.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.aepd.es\/es\/prensa-y-comunicacion\/notas-de-prensa\/aepd-actualiza-guia-cookies\/\" target=\"_blank\" rel=\"noreferrer noopener\">Read the AEPD guidelines on consent and cookie walls (in Spanish)<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-italian-dpa-on-cookie-walls\">The Italian DPA on cookie walls<\/h3>\n\n\n\n<p>On November 26, 2020, the Italian data protection authority <a href=\"https:\/\/www.garanteprivacy.it\/home_en\/\" target=\"_blank\" rel=\"noreferrer noopener\">Garante Per La Protezione Dei Dati Personali<\/a>&nbsp;released <a href=\"https:\/\/www.garanteprivacy.it\/documents\/10160\/0\/Consultazione+sulle+%E2%80%9CLinee+guida+sull%E2%80%99utilizzo+di+cookie+e+di+altri+strumenti+di+tracciamento%E2%80%9D+-+Allegato+1+-+Linee+guida.pdf\/72eab081-e4c4-4500-77c3-8b6957f8cd12\/?version=2.0\" target=\"_blank\" rel=\"noreferrer noopener\">new guidelines on cookies and cookie walls (in Italian)<\/a>.<\/p>\n\n\n\n<p>As most other EU data protection authorities, <strong>cookie walls are also deemed illegal in Italy<\/strong>.<\/p>\n\n\n\n<p>An exception is made if the website offers access to equivalent content or services, but this will be determined by the Italian DPA on a case-by-case basis.<\/p>\n\n\n\n<p>Apart from clarifying that cookie walls are illegal, the guidelines from the Italian DPA also deem scrolling to be inadequate as consent, meaning that consent must be an active, affirmative, explicit action from the user to be valid.<\/p>\n\n\n\n<p>The <a
