{"id":2341,"date":"2022-08-12T09:14:10","date_gmt":"2022-08-12T09:14:10","guid":{"rendered":"https:\/\/www.cookiebot.com\/en\/?p=2341"},"modified":"2026-03-12T09:16:02","modified_gmt":"2026-03-12T08:16:02","slug":"virginia-vcdpa-article","status":"publish","type":"post","link":"https:\/\/www.cookiebot.com\/en\/virginia-vcdpa-article\/","title":{"rendered":"Virginia Consumer Data Protection Act (VCDPA)"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\" id=\"h-what-is-the-virginia-consumer-data-protection-act-vcdpa\"><strong>What is the Virginia Consumer Data Protection Act (VCDPA)?<\/strong><\/h2>\n\n\n\n<p>Virginia\u2019s data privacy law, most often referred to as the \u201cVCDPA\u201d, is the second comprehensive data protection legislation to be signed into law in the United States after the <a href=\"https:\/\/www.cookiebot.com\/en\/ccpa\/\">California Consumer Data Privacy Act (CCPA)<\/a> and subsequent <a href=\"https:\/\/www.cookiebot.com\/en\/cpra\/\">California Privacy Rights Act (CPRA)<\/a> broke ground.<\/p>\n\n\n\n<p><a href=\"https:\/\/iapp.org\/news\/a\/virginia-passes-the-consumer-data-protection-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">The VCDPA takes effect January 1, 2023<\/a>.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/iapp.org\/news\/a\/vcdpa-amendment-process-complete-text-finalized-ahead-of-jan-1-effective-date\/\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia Consumer Data Protection Act (VCDPA)<\/a> operates based on the <strong>consumer right to opt-out<\/strong> of having personal data collected, processed, and sold. It also requires companies and organizations to obtain the <strong>prior consent from end-users<\/strong> if they collect or process sensitive personal data, which we will take a deeper look at below.<\/p>\n\n\n\n<p>This is identical to the <a href=\"https:\/\/gdpr.eu\" target=\"_blank\" rel=\"noreferrer noopener\">EU\u2019s General Data Protection Regulation (GDPR)<\/a> that has been in effect since 2018. This is usually done through a consent management platform (CMP) with consent banners (or \u201ccookie banners\u201d) on the website where user data is collected.<\/li>\n\n\n\n<li>The VCDPA includes so-called \u201cfair information practice principles (FIPPs)\u201d \u2013 these define how collection of user data is done in a legal way, e.g. \u201chaving a specific, disclosed purpose for collecting personal data\u201d and providing users with a privacy notice and policy detailing what kind of data the website or company collects and how.<\/li>\n\n\n\n<li>The VCDPA applies to companies or for-profit organizations doing business in Virginia or producing products and services for Virginia residents. If you have a for-profit company located outside of Virginia but you have users from inside Virginia (e.g. by offering online services that Virginia residents use), you are also required to be compliant with the VCDPA.<\/li>\n\n\n\n<li>The VCDPA defines \u201csale\u201d as the \u201cexchange of personal data for monetary consideration by a controller to a third party\u201d, e.g. your website to an adtech business.<\/li>\n\n\n\n<li>The VCDPA defines \u201cprocessing\u201d as \u201c\u2026any operation or set of operations performed, whether by manual or automated means, on personal data or on sets of personal data, such as the collection, use, storage, disclosure, analysis, deletion, or modification of personal data.\u201d<\/li>\n\n\n\n<li>The VCDPA distinguishes between \u201cpersonal data\u201d and \u201csensitive personal data\u201d: \u201cSensitive personal data\u201d includes data from users under the age of 13, health and biometric data, geolocation data and data about racial or ethnic origin, religious beliefs, political convictions, and sexual orientation. It also talks about \u201cde-identified\u201d data \u2013 data that is anonymous \u2013 and states that controllers must take \u201creasonable measures to ensure that the data can\u2019t be associated with an individual.\u201d<\/li>\n\n\n\n<li>The VCDPA takes effect on January 1, 2023 and will be enforced by the Virginia Attorney General.<\/li>\n\n\n\n<li>Fines for non-compliance with Virginia\u2019s VCDPA can go up to $7,500 per infringement, but a 14-day notice of violation will be issued to non-compliant companies prior to fines with the chance to rectify and become compliant.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What does the VCDPA say about website cookies?<\/strong><\/h3>\n\n\n\n<p>The Virginia Consumer Data Protection Act (VCDPA) is clearer than most other data privacy laws when it comes to cookies: if your website uses cookies and trackers to collect and process personal data from individuals inside the state of Virginia, users must have the option to opt out of that personal data being used for so-called targeted advertising.<\/p>\n\n\n\n<p><em>Targeted advertising<\/em> is when websites and companies use personal data to tailor marketing campaigns to the users, and is <a href=\"https:\/\/iapp.org\/news\/a\/vcdpa-amendment-process-complete-text-finalized-ahead-of-jan-1-effective-date\/\" target=\"_blank\" rel=\"noreferrer noopener\">defined in the VCDPA<\/a> as advertising that is \u201cselected based on personal data obtained from a consumer\u2019s activities over time and across nonaffiliated websites or online applications to predict such consumer\u2019s preferences or interests.\u201d<\/p>\n\n\n\n<p>In other words, under the Virginia Consumer Data Protection Act (VCDPA), users inside Virginia must be enabled to opt out of cookies and trackers on websites that collect personal data for the purpose of targeted advertising.<\/p>\n\n\n\n<p>This is usually done through a consent management platform (CMP) that automatically detects cookies and controls them based on the consent state of users, as they navigate a consent banner (also known as a \u2018cookie banner\u2019) on the website they visit.<\/p>\n\n\n\n<p>So, if your company or organization is already in compliance with the EU\u2019s GDPR, there\u2019s a good chance that with minimal effort, you can make your consent management solution work for compliance with Virginia\u2019s VCDPA too.<\/p>\n\n\n\n<p>If you\u2019re not and looking to start becoming compliant, <a href=\"https:\/\/www.cookiebot.com\/en\/\">try our free website scan to see all cookies and trackers in use on your domain<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized is-style-cb-rounded\"><img decoding=\"async\" src=\"https:\/\/www.cookiebot.com\/en\/wp-content\/uploads\/sites\/7\/2022\/08\/VCDPA.jpeg\" alt=\"Illustration of a birdge - Cookiebot\" class=\"wp-image-2346\" width=\"770px\" height=\"513px\" srcset=\"https:\/\/www.cookiebot.com\/en\/wp-content\/uploads\/sites\/7\/2022\/08\/VCDPA.jpeg 500w, https:\/\/www.cookiebot.com\/en\/wp-content\/uploads\/sites\/7\/2022\/08\/VCDPA-300x200.jpeg 300w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What are the VCDPA requirements for companies and organizations?<\/strong><\/h3>\n\n\n\n<p>The Virginia Consumer Data Protection Act (VCDPA) requires companies and organizations to adhere to several protocols and duties, when processing data from consumers.<\/p>\n\n\n\n<p>Virginia\u2019s VCDPA asks businesses to ensure that their personal data processing operates based on transparency, security, and consent, much like the EU\u2019s GDPR does.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.hutchlaw.com\/blog\/an-overview-of-the-virginia-consumer-data-protection-act\" target=\"_blank\" rel=\"noreferrer noopener\">In a nutshell<\/a>, what the VCDPA asks companies and organizations to do is to discover what personal data is processed, map out how and to whom they share personal data with third parties, and manage how personal data is stored as well as protect personal data from breaches and abuse.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>The VCDPA requires companies and organizations to<\/strong>:<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide end-users with a privacy notice that includes what kind of data is processed and why, what kind of data is shared with third parties and who the third parties are, and how and by what means users can exercise their rights,<\/li>\n\n\n\n<li>Disclose if personal data is processed, by the controller or a third party, for targeted advertisement \u2013 and how end-users can opt-out,<\/li>\n\n\n\n<li>Establish security practices for their data collection and processing,<\/li>\n\n\n\n<li>Respond to consumer requests within 45 days of receiving the request,<\/li>\n\n\n\n<li>Establish a way for consumers to appeal a refusal of their initial request,<\/li>\n\n\n\n<li>Limit collection of personal to what is adequate, relevant, and reasonably necessary for the disclosed purpose of the collection,<\/li>\n\n\n\n<li>Only process personal data for other purposes than those disclosed if the consumer gives their consent,<\/li>\n\n\n\n<li>Not discriminate against consumers based on the processing of their data.<\/li>\n<\/ul>\n\n\n\n<p>In addition to these requirements, companies and organizations (or \u201ccontrollers\u201d) need to enter into a so-called \u201c<strong>controller\/processor agreement<\/strong>\u201d, which must disclose the type of personal data that will be processed, the purpose for processing the personal data, and the duration of processing.<\/p>\n\n\n\n<p>For the processor, the agreement comes with certain requirements, including to ensure confidentiality of the data processing, provide all personal data in possession if requested to, and delete all personal data when processing and services are done if requested to.<\/p>\n\n\n\n<p>For companies and organizations already in compliance with the EU\u2019s GDPR and California\u2019s CCPA\/CPRA, compliance with Virginia\u2019s VCDPA is pretty straightforward with minimal adjustments.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What does a privacy notice look like under Virginia\u2019s VCDPA?<\/strong><\/h3>\n\n\n\n<p>A \u201cprivacy notice\u201d or \u201cprivacy policy\u201d is a common requirement under most data privacy laws in the world, and Virginia\u2019s VCDPA is no exception.<\/p>\n\n\n\n<p>The VCDPA requires a company\u2019s privacy notice to be posted in the place where the data collection takes place \u2013 most commonly a website. It must be easy to find, accessible for end-users, and written in clear and understandable language.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>A VCDPA-compliant privacy notice should include<\/strong>:<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Categories of personal data collected or processed on the website,&nbsp;<\/li>\n\n\n\n<li>Categories of personal data shared with third parties,<\/li>\n\n\n\n<li>Categories of third parties with whom data is shared,<\/li>\n\n\n\n<li>Purpose of data collection and processing,<\/li>\n\n\n\n<li>Disclosure of any data collection and\/or processing for the purpose of targeted advertising purposes with clear instructions for how consumers can opt-out.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized is-style-cb-rounded\"><img decoding=\"async\" src=\"https:\/\/www.cookiebot.com\/en\/wp-content\/uploads\/sites\/7\/2022\/08\/rights-VCDPA.jpeg\" alt=\"Illustration of a laptop with a bird next to it - Cookiebot\" class=\"wp-image-2348\" width=\"770px\" height=\"513px\" srcset=\"https:\/\/www.cookiebot.com\/en\/wp-content\/uploads\/sites\/7\/2022\/08\/rights-VCDPA.jpeg 500w, https:\/\/www.cookiebot.com\/en\/wp-content\/uploads\/sites\/7\/2022\/08\/rights-VCDPA-300x200.jpeg 300w\" sizes=\"(max-width: 500px) 100vw, 500px\" \/><figcaption class=\"wp-element-caption\"><em>Like California\u2019s CCPA and the EU\u2019s GDPR, Virginia\u2019s VCDPA gives end-users in the state rights over their own data.<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What rights does Virginia\u2019s VCDPA empower end-users with?<\/strong><\/h3>\n\n\n\n<p>The Virginia Consumer Data Protection Act (VCDPA) affords Virginia residents several rights over the data they generate online.<\/p>\n\n\n\n<p>Virginia\u2019s VCDPA affords residents of the state the following rights:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To know if their personal data is being collected or processed,<\/li>\n\n\n\n<li>To get access to their personal data by the controller collecting or processing it,&nbsp;<\/li>\n\n\n\n<li>To get a copy of their personal data held by a controller in a portable and usable format,<\/li>\n\n\n\n<li>To not be discriminated against for exercising their rights,<\/li>\n\n\n\n<li>To have inaccurate personal data corrected,<\/li>\n\n\n\n<li>To have personal data deleted,<\/li>\n\n\n\n<li>To opt out of having their personal data collected or processed for the purposes of targeted advertising, sale, and profiling.<\/li>\n<\/ul>\n\n\n\n<p>Both the consumer rights and business obligations found in the Virginia Consumer Data Protection Act (VCDPA) are closely related to those found in the EU\u2019s General Data Protection Regulation (GDPR) and in the California Consumer Protection Act (CCPA) and California Privacy Rights Act (CPRA).<\/p>\n\n\n\n<p>Let\u2019s have a look at what\u2019s different and similar about the Virginia VCDPA, EU\u2019s GDPR and California\u2019s CCPA\/CPRA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How is Virginia\u2019s VCDPA different from California\u2019s CCPA\/CPRA and EU\u2019s GDPR?<\/strong><\/h2>\n\n\n\n<p>Looking across the Atlantic, Virginia\u2019s VCDPA borrows provisions from another major piece of data privacy legislation, namely the EU\u2019s GDPR.&nbsp;<\/p>\n\n\n\n<p>To reiterate a previous point: <strong>for companies and organizations who are already in compliance with the EU\u2019s GDPR and California\u2019s CCPA\/CPRA, becoming compliant with Virginia\u2019s VCDPA should be possible with minor adjustments<\/strong>.<\/p>\n\n\n\n<p>In the following section, we outline the most important differences and similarities between the Virginia Consumer Data Protection Act (VCDPA) and the EU\u2019s GDPR and California\u2019s CCPA\/CPRA.<\/p>\n\n\n\n<p>Like the EU\u2019s GDPR, Virginia\u2019s VCDPA requires you to <strong>obtain explicit and affirmative consent<\/strong> from your website\u2019s users when processing sensitive data. This makes the VCDPA's consent provision broader and stricter than California\u2019s CCPA\/CPRA, which only applies to minors.&nbsp;<\/p>\n\n\n\n<p>The VCDPA's definition of consent is even word-for-word taken from the EU\u2019s GDPR, requiring the <strong>\u201cfreely given, specific, informed and unambiguous agreement\u201d<\/strong> to constitute a valid end-user consent.&nbsp;<\/p>\n\n\n\n<p>Also inspired by the EU\u2019s GDPR, Virginia\u2019s VCDPA requires you to <strong>perform data protection assessments <\/strong>for so-called \u201chigh risk processing\u201d of personal data, which covers if you engage in targeted advertisement, i.e. the selling of personal data and profiling.<\/p>\n\n\n\n<p>When comparing Virginia\u2019s VCDPA to California\u2019s CCPA\/CPRA, as we did in the introduction of this article, it becomes clear that (although inspired by California\u2019s model) Virginia has gone its own way with its US data privacy law.<\/p>\n\n\n\n<p>The biggest differences between Virginia\u2019s VCDPA and California\u2019s CCPA\/CPRA are \u2013&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Scope<\/strong>: Virginia\u2019s VCDPA applies to fewer websites and businesses than California\u2019s CCPA\/CPRA, since entities like government agencies, nonprofits and higher education institutions are exempt from compliance with the law.<\/li>\n\n\n\n<li><strong>Personal data<\/strong>: Virginia\u2019s VCDPA excludes a much larger part of end-user\u2019s data, since its definition of what is publicly available is much broader than California\u2019s CCPA\/CPRA.&nbsp;<\/li>\n\n\n\n<li><strong>Fines and enforcement<\/strong>: Virginia\u2019s VCDPA comes with much bigger fines and harder penalties than California\u2019s CCPA\/CPRA. While both describe maximum penalties of $7,500 per violation, Virginia\u2019s VCDPA also opens for financial recovery of legal fees and investigative costs, and violations are not limited to \u201cintentional violations\u201d. On the other hand, as described above, California allows for a private right of action that can grant end-users up to $750 per violation.&nbsp;<\/li>\n\n\n\n<li><strong>Sale<\/strong>: Virginia\u2019s VCDPA has a narrower definition of sale, defining it as \u201cthe exchange of personal data for monetary consideration by the controller to a third party\u201d, whereas California\u2019s CCPA define it as \u201cany sharing, disclosure or sale of personal information with a third party in exchange for money or other value.\u201d&nbsp;<\/li>\n\n\n\n<li><strong>Rights<\/strong>: Virginia\u2019s VCDPA empower Virginia residents with much broader opt-out rights than in California, creating a way for end-users in Virginia to not only opt out of the sale of their personal information, but also specifically opt out of targeted advertisement and data profiling, i.e. the collection of personal data and inferences made for the purpose of predicting user behavior.<\/li>\n<\/ul>\n\n\n\n<p>Unlike both the CCPA and GDPR, the VCDPA does not afford Virginia residents a private right of action, meaning that they cannot sue companies or organizations for violations and infringements.
