Website trackers that collect and process users\u2019 personal data need the <strong>explicit consent of end-users before they can be activated and used for <\/strong><strong>tracking website activity<\/strong>.<\/p>\n\n\n\n<p><a href=\"\/en\/gdpr-cookies\/\"><strong>GDPR cookie consent<\/strong><\/a> must be given freely (i.e. not forced or as a condition for services) and it must be granular (i.e. users need to be able to give their consent to some website trackers and not others).<\/p>\n\n\n\n<p>Your obligation to inform your users means that you need to tell them about:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>what kinds of personal data your internet tracking tools collect<\/li>\n\n\n\n<li>what purposes you collect personal data for<\/li>\n\n\n\n<li>where you send personal data to<\/li>\n\n\n\n<li>what third parties you share personal data with<\/li>\n\n\n\n<li>what website trackers are used to collect and process data (e.g. cookies), including detailed data on their technical properties<\/li>\n<\/ul>\n\n\n\n<p>Users must be made aware of all details about your web tracking practices before they can provide an informed, compliant consent. This information can\u2019t be provided to them after they\u2019ve given consent or be buried in a difficult legal text.<\/p>\n\n\n\n<p>When a user consents to the website tracking on your domain, you need to<strong> <\/strong>document this consent and securely store it.<\/p>\n\n\n\n<p>Consent must also be renewed every 6 to 12 months, according to relevant national data protection guidelines.<\/p>\n\n\n\n<p>Personal data under the EU\u2019s GDPR include, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>name, location, email, address,<\/li>\n\n\n\n<li>IP addresses, search history, browser history,<\/li>\n\n\n\n<li>purchase history, credit information, preferences and settings,<\/li>\n\n\n\n<li>inferences about sexual orientation, political convictions, religious beliefs<\/li>\n\n\n\n<li>\u2026and more.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">California Privacy Rights Act (CPRA), California Consumer Privacy Act (CCPA) and <strong>website tracking<\/strong><\/h3>\n\n\n\n<p>If you have users from California, the state-wide <a href=\"\/en\/ccpa\/\"><strong>California Consumer Privacy Act (CCPA)<\/strong><\/a>, as amended by <a href=\"\/en\/cpra\/\"><strong>California Privacy Rights Act (CPRA)<\/strong><\/a>, applies to your website tracking if you meet its definition of a business.<\/p>\n\n\n\n<p>Unlike the EU\u2019s GDPR, the CCPA doesn\u2019t require you to obtain end-user consent before tracking users, but it does require you to provide all the same transparency around your website tracking practices as the GDPR, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>what kinds of personal information you collect<\/li>\n\n\n\n<li>what purposes you collect this personal information for<\/li>\n\n\n\n<li>who you share this personal information with<\/li>\n<\/ul>\n\n\n\n<p>End-users from California need to be able to opt out of your web tracking by a link that says \u201d<strong>Do Not Sell or Share My Personal Information\u201d<\/strong> on your website\u2019s <a href=\"\/en\/cookie-banner\/\"><strong>cookie banner<\/strong><\/a>. Should users click on this link, you\u2019re not allowed to track their personal information any longer.<\/p>\n\n\n\n<p>This is a manual process for users, who must click on this link for each website they visit. Users can also enable <a href=\"https:\/\/globalprivacycontrol.org\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Global Privacy Control<\/strong><\/a>, a browser-based setting or extension where users set their privacy preferences, such as not wanting their personal data to be shared or sold. The extension then automatically notifies websites of these privacy preferences when the user visits.
